By downloading, installing, or using the Fluemingo mobile application ("the App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms constitute a legally binding agreement between you ("User") and FlueHero ("we", "us", "our"), the publisher of Fluemingo.
Fluemingo is published and operated by FlueHero, a trading name registered in France as a sole trader (auto-entrepreneur).

Fluemingo is a language learning mobile application that allows users to:
We reserve the right to modify, suspend, or discontinue any feature of the App at any time, with or without notice.
You must be at least 13 years old to use Fluemingo. By creating an account, you confirm that you meet this age requirement. If you are under 18, you represent that you have obtained parental or guardian consent to use the App.
To access certain features, you must create an account by providing your first name, last name, and email address. You agree to provide accurate, current, and complete information.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account at: legal@fluemingo.com
You may delete your account at any time from within the App settings. We reserve the right to suspend or terminate your account if you violate these Terms.
By using Fluemingo, you agree not to:

All content, features, and functionality of the App (including but not limited to text, graphics, logos, audio content, software, and design) are owned by FlueHero or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the App without our prior written consent. The Fluemingo name and logo are trademarks of FlueHero.
If the App offers paid subscriptions or in-app purchases, payment will be processed through the applicable app store (Apple App Store or Google Play). You agree to the store's terms and conditions for payments. Subscription fees are non-refundable except as required by law or as stated in the store's refund policy. We may change subscription prices with reasonable notice; continued use after a price change constitutes acceptance.
The App and its content are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. Language learning outcomes depend on individual effort and use; we do not guarantee any particular level of proficiency or result.
To the maximum extent permitted by applicable law, FlueHero and its representatives shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of or inability to use the App. Our total liability for any claims arising from these Terms or the App shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or one hundred euros (€100), whichever is greater. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability; in such cases, our liability will be limited to the fullest extent permitted by law.
You agree to indemnify, defend, and hold harmless FlueHero and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.
These Terms are governed by the laws of France. Any dispute arising from or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts of France. If you are a consumer, you may also benefit from any mandatory consumer protection provisions of your country of residence.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App and/or by email to the address associated with your account. Your continued use of the App after the effective date of the changes constitutes acceptance of the revised Terms. If you do not agree, you must stop using the App and may delete your account.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.
